Gymanager provides cloud-based software for fitness operations including:

You agree to:

Users are strictly responsible for all activity conducted under their account credentials.

Access to certain premium features requires an active paid subscription plan. Subscriptions may be billed on the following cycle terms:

Pricing schedules may change over time with prior notice provided to account owners.

Users agree to:

• Pay all applicable subscription fees in accordance with selected plan billing terms.
• Authorize recurring billing where applicable to prevent service interruptions.
• Keep payment methods and billing contact information accurate and current.

Unless required by applicable mandatory law:

Gymanager receives a limited, non-exclusive license to store and process such data solely to operate, deliver, and maintain the service on your behalf.

Gymanager owns all software, source code, UI/UX architecture, branding, trademarks, logos, system designs, documentation, and APIs.

We aim for high platform availability (99.9% target uptime) but do not guarantee 100% uninterrupted service. Scheduled maintenance, emergency upgrades, unexpected technical issues, or force majeure events may temporarily affect availability.

We perform periodic cloud backups; however, users are encouraged to maintain their own local exports of critical business records. Gymanager is not liable for data losses caused by user deletion, local operator errors, or events beyond our reasonable control.

We reserve the right to suspend or terminate accounts for:

To the maximum extent permitted by applicable law:

• Gymanager is provided strictly on an “as is” and “as available” basis.
• We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, business interruption, or data loss.
• Our total aggregate liability arising from your use of the service will not exceed the total subscription fees paid by you during the preceding twelve (12) months.

You agree to indemnify, defend, and hold harmless Gymanager and its officers, directors, and employees from any claims, damages, liabilities, costs, and expenses arising out of your misuse of the platform, violation of these Terms, or infringement of any third-party rights.

Use of Gymanager is also strictly governed by our Privacy Policy, which is incorporated into these Terms by reference.

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.

We may revise these Terms periodically. Continued access or use of Gymanager following publication of changes constitutes full acceptance of the updated Terms.
